"The City does not have a responsibility to simply
answer all questions as you have posed them in your correspondence dated March 29, 2024, unless the answer to the questions can be found in municipal data. “Government data” does not include unrecorded mental impression of government employees or city council members. Keezer v. Spickard, 493 N.W.2d 614 (Minn. Ct. App. 1993). As stated by the Court of Appeals, “we cannot believe the legislature intended the term ‘government data,’ to be literally interpreted to include unrecorded data that exists only in a human brain. Interpreting ‘government data’ to include mental impressions formed by public employees during the course of employment would lead to absurd results.” 493 N.W.2d at 617. The City provides the following responses as to your questions contained within your March 29, 2024, correspondence to the City."

In addition to attaining the rank of Sergeant with the MAPLE PLAIN (Minnesota) POLICE DEPARTMENT (now WEST HENNEPIN DEPARTMENT OF PUBLIC SAFETY), I joined the HENNEPIN COUNTY SHERIFF'S OFFICE (Minnesota's Largest Sheriff's Office) in October 1969 as a Senior Deputy Sheriff and attained the rank of Sergeant in both the RADIO/COMMUNICATIONS DIVISION as well as in the WARRANT/FUGITIVE DIVISION.
While continuously maintaining a valid MINNESOTA POLICE OFFICER STANDARDS & TRAINING BOARD (P.O.S.T.) License until it's expiration in 1997, I retired from the Sheriff's Office in September 1984. I am also a former EMERGENCY MEDICAL TECHNICIAN (E.M.T.) and a UNITED STATES AIR FORCE FIRE PROTECTION SPECIALIST.

"As an ELECTED OFFICIAL of the CITY OF HAMBURG, I was SO CONCERNED about Gruenhagen's IMPULSIVE, NEGATIVE BEHAVIOR that, on November 5, 2014, I sent a TEN PAGE LETTER to (then) City Councilmember Chris Lund; who was a member of the infamous HAMBURG PERSONNEL COMMITTEE, expressing my grave concern about Gruenhagen's HIGHLY INAPPROPRIATE workplace conduct and behavior. A copy of that ten page letter to Lund is contained herein.
In addition to my ten page letter to Lund, I also had a lengthy telephone conversation with him (Lund) discussing Gruenhagen's poor representation of, and liability to, the CITY OF HAMBURG. Further, I went to then MAYOR RICHARD MALZ and discussed with him, at length, my concerns about Gruenhagen that I had discussed with Lund, as well as Gruenhagen's ACTIONS, 'EXPLOSIVE' TEMPER and INAPPROPRIATE, EMBARRASSING BEHAVIOR.
COUNCILMEMBER CHRIS LUND, MAYOR RICHARD MALZ and the ENTIRE HAMBURG CITY COUNCIL TOTALLY IGNORED Gruenhagen's 'warning signs'; as well as my MAKING LUND and MALZ, AWARE of what was taking place involving Gruenhagen.
Like every other time that Gruenhagen's inappropriate actions and misdeeds were brought up and questioned, INCLUDING THIS TIME, the HAMBURG SIX 'covered' for him, his deplorable behavior & actions; and NOTHING WAS EVER DONE.
They were his 'enablers' and; in the FOUR YEARS that I was on the HAMBURG CITY COUNCIL, I don't EVER recall ANY DISCIPLINARY ACTION TAKEN AGAINST GRUENHAGEN for his inappropriate actions and behavior !!"

Minnesota Governor Tim Walz recently signed a bill that will send $30 MILLION to 'cash-strapped' rural Emergency Medical Services. The legislation will provide $24 MILLION in short-term 'emergency aid' for E.M.S. in greater
Minnesota. The other $6 MILLION will go towards a "SPRINT MEDIC" pilot program to test the efficiency of 'roving Paramedics'. in rural Minnesota. Of course, the bill also added another 'layer' of 'government
bureaucracy'; an 'OFFICE OF EMERGENCY SERVICES' that will 'oversee' Minnesota's E.M.S. network. I wasn't aware that there is anything wrong with Minnesota's current E.M.S. 'network' that
needed new/more 'oversight'; it seems to me that someone is 'LOOKING FOR A 'SOLUTION' TO A 'PROBLEM' THAT DOESN'T EXIST !! (Or a 'cushy' job with the State !)
As far as I know, the E.M.S. Program in Minnesota ISN'T BROKEN but it probably can use some 'enhancements'. One of those 'enhancements' is ALREADY AVAILABLE, with 'LOCAL CONTROL'; already 'IN THE HANDS' of LOCAL JURISDICTIONS !! It's 'common sense'
that 'LOCAL CONTROL' is MORE EFFECTIVE, EFFICIENT and ORGANIZED when the LOCAL Police, Fire and E.M.S. personnel who ENCOUNTER THE SICK & INJURED EVERY DAY, IN THEIR OWN AREA are 'calling the shots'; NOT somebody sitting in St. Paul !!

MISCONDUCT OF PUBLIC OFFICER OR EMPLOYEE
A public officer or employee who does any of the following, for which no other sentence is specifically provided by law, may be sentenced to imprisonment for not more than 364 days or to payment of a fine of not more than $3,000, or both:
(1) intentionally fails or refuses to perform a known mandatory, non-discretionary, ministerial duty of the office or employment within the time or in the manner required by law; or
(2) in the capacity of such officer or employee, does an act knowing it is in excess of lawful authority or knowing it is forbidden by law to be done in that capacity; or
(3) under pretense or color of official authority intentionally and unlawfully injures another in the other's person, property, or rights; or
(4) in the capacity of such officer or employee, makes a return, certificate, official report, or other like document having knowledge it is false in any material respect.
PUBLIC OFFICIALS are SUPPOSED to be held to the SAME 'CONDUCT & BEHAVIOR STANDARDS' as are employees of privately owned companies. But, as most everyone Is painfully aware, that isn't always the case.
When an employee of a privately owned company conducts himself or herself in an unacceptable manner, they are subject to the 'consequences' of their actions, as determined by their Supervisors charged with ensuring the uninterrupted production of the private company's 'product' and/or the uninterrupted 'free flowing' of 'services' provided by that private company, coupled with financial accountability and responsibility.
Similarly, while usually not involved In the production of a 'product'; municipalities MUST ensure the smooth and efficient 'delivery of services' to its residents & be even more vigilant regarding financial accountability & responsibility because taxpayer dollars 'fund' the Day-To-Day 'operation' of the municipality.
When a PUBLIC EMPLOYEE conducts himself or herself in an unacceptable manner, they too are, or SHOULD be; subject to the 'consequences' of their actions. Normally, the 'administration' of a privately owned company & the 'governing body' of the municipality, designates the 'Chain Of Command' to deal with ANY form of EMPLOYEE MISCONDUCT In ANY degree.
In municipalities, normally The HUMAN RESPOUCES DIRECTOR, the CITY ADMINISTRATOR or other designated person or authority, are the persons designated to deal with issues involving EMPLOYEE MISCONDUCT. Additionally, the State of Minnesota has a very good (but seldom used) law (Statute 609.43) that very clearly defines 'MISCONDUCT OF PUBLIC OFFICER OR EMPLOYEE'.
Once it has been established that, in fact; a PUBLIC OFFICIAL (or employee) has committed MISCONDUCT, the 'process' of dealing with that PUBLIC EMPLOYEE's MISCONDUCT is addressed. However, what if the PUBLIC EMPLOYEE(s) is ALSO a PUBLIC OFFICIAL of that municipality ?
Logically, the FIRST authority/responsibility; lies with the municipality's CITY COUNCIL MEMBERS to determine what action/discipline is warranted & appropriate for the PUBLIC OFFICIAL's MISCONDUCT.
Should the City Council Members FAIL in fulfilling their duties and responsibilities, AS THEY DID IN HAMBURG; then the SECOND authority/responsibility lies with the municipality's MAYOR to determine what action/discipline is warranted and appropriate.
But because there is NO ACCOUNTABILITY and there are NO CHECKS and BALANCES in place to PREVENT or DETECT ILLICIT BEHAVIOR of ANY kind by ANY PUBLIC OFFICIAL, 'COVER-UP', MISCONDUCT and CORRUPTION by PUBLIC OFFICIALS RUNS RAMPANT thereby COSTING HAMBURG TAXPAYERS TENS OF THOUSANDS OF DOLLARS ANNUALLY !!

"The REASON that I SPECIFICALLY REQUESTED that we all meet at City Hall was for the DISTINCT
PURPOSE of INCLUDING GRUENHAGEN to ACCOMPANY us to the Community Hall. After being elected to the HAMBURG CITY COUNCIL, it didn't take me long to learn and realize that Gruenhagen HAD to be included in EVERYTHING for the reasons previously stated.
A time and date was agreed upon for the ROBB'S
ELECTRIC representative to meet us at the City Hall. I was waiting outside of City Hall when the ROBB'S
ELECTRIC truck pulled into the parking lot.
I walked over and greeted the man getting out of his truck, introduced myself to him and stated we could go into City Hall and I would introduce him to Gruenhagen; also stating that he (Gruenhagen)
would be accompanying us to the Community Hall.
WELL !! As I opened the door to the City Hall to go in, I heard Gruenhagen, who was leaning up against the 'pass through' to the kitchen, on a cordless phone, 'talking very loudly' (OK; he was literally SCREAMING) to whoever was 'on the other end'
of the conversation !!
Needless to say, I was embarrassed NOT ONLY
for myself, but I was ALSO EMBARRASSED
for the ENTIRE CITY !!
'Walking in' on one of his many 'tirades' (that I've observed TOO MANY TIMES) that was taking place was, as you can understand; a VERY
AWKWARD SITUATION; a 'situation' that I wanted to quickly REMOVE MYSELF from, as
well as the ROBB'S ELECTRIC representative !!
As we exited City Hall; the last words heard from Gruenhagen, to whoever he was talking to on the 'other end of the line', were; "THEY CAN TAKE
THIS JOB AND SHOVE IT" !!
Once out of City Hall and in the parking lot, I apologized to the ROBB'S ELECTRIC representative for what he (we) had just witnessed and stated
words to the effect, "The City Clerk" or ("Jeremy") must be having a bad day." Just 'one' of 'many'.
The 'ROBB'S GUY' and I went to the Community Hall without Gruenhagen; who would later present the 'event' to the HAMBURG CITY COUNCIL in such a 'distorted manner' that he would gain the 'sympathy', AGAIN; of the HAMBURG CITY COUNCIL, would make ME look like the 'BAD GUY' and he was the person 'wearing the white hat' !!
THESE PEOPLE LIE." THEY BELONG IN JAIL !!
(My subsequent three letters to ROBB'S ELECTRIC attempting to explain but, REALLY APOLOGIZING; for what their employee had unfortunately witnessed; are contained in my book and are POSTED ON THIS WEBSITE about the CITY OF HAMBURG for those of you that haven't purchased a copy of my book.)

They're his 'ENABLERS' !!
And, YES; THERE'S EVEN MORE 'EVENTS', like the one just described above; INVOLVING GRUENHAGEN; that I witnessed 'firsthand' !!
To the City's detriment, Gruenhagen is an 'AUTOCRAT'. Why do you think the City has had such a 'high turnover' of so many PUBLIC WORKS (4) & UTILITY 'BILLING CLERK (4) employees in TEN YEARS in a City of LESS THAN 600 RESIDENTS ??
