Dear Councilmember Lund:

Pursuant to our telephone conversation last week, I bring the following topics involving Hamburg City Clerk/Treasurer Jeremy Gruenhagen to the attention of the
Personnel Committee for their consideration and recommendation(s) to be forwarded to the full Hamburg City Council. I have talked with Councilmember Trebesch
about the matters outlined below. Steve suggested that after you and he, as members of the Personnel Committee, have read over everything, that the two of you
meet with the Hamburg City Attorney to discuss what the city’s options are. I believe that to be an excellent suggestion !!

However, to avoid ANY question of violating the state’s ‘Open Meeting’ law, I PURPOSELY have NOT provided Councilmember Trebesch with a copy of this
letter or any of the enclosed documents; you’ll have to ‘share’.
I
MISREPRESENTATION

An assertion or manifestation by words or conduct that is not in accord with the facts.

After my sending two, separate letters to Robb’s Electric and after not receiving any response to those two letters or to two separate telephone calls placed to
Robb’s Electric, I have been wholly UNABLE TO VERIFY the existence ANY of the negative comments being said or any  negative information, allegedly
stated against me, by any employee of Robb’s Electric, to him, as stated by Mr. Gruenhagen to, and before, the entire Hamburg City Council at the
City Council Meeting on September 9th.

When Mr. Gruenhagen was describing, before the entire Hamburg City Council, the details of the alleged ’complaint’ he received against me by an employee of
Robb’s Electric, I noticed very distinct changes in his normal vocalization, tone of his voice and ’body language’; not consistent with Mr. Gruenhagen’s usual
mannerisms and demeanor that I have continually observed for the past several years.

I immediately suspected that the details of the ‘complaint’ against me Mr. Gruenhagen stated that he allegedly received were most probably, in fact, at best exaggerated (if any complaint was actually received at all), or, at worst, fabricated by Mr. Gruenhagen.

I truly, and simply,  don’t believe that any such complaint against me was ever initiated by Robb’s Electric. The facts simply don’t support Mr. Gruenhagen’s allegation.

Were these alleged ‘complaints’ against me (if there were any, in fact), ‘solicited’ by Mr. Gruenhagen? Probably. Or, were the ‘fabricated’ by Mr. Gruenhagen. Quite possibly.

In the approximate twenty months that I have been a member of the Hamburg City Council, I have ALWAYS, unequivocally ’supported’ Mr. Gruenhagen. More than
once he has told me, in the past, that I turned out to be his ‘strongest ally’. On several occasions, Mr. Gruenhagen told me, directly, that “If it weren’t for you and
Steve (Trebesch), I wouldn’t ‘be here.’”.

I fully trusted and respected Mr. Gruenhagen since the day I was elected to the Hamburg City Council (and before) and believed him to be my good friend.

Now, however, after what I’ve personally experienced because of him and what he’s done against me, how can I ever again trust him again after what I’ve just
witnessed and the personal embarrassment, humiliation and degradation that I’ve been forced to endure; by someone who I believed to be sincere and was
my good friend ? 
II
INSUBORDINATION

Insubordination is a defiance of authority directed toward a higher level manager or boss.

When asked to identify the vendor who allegedly made the complaint to him, Mr. Gruenhagen reluctantly stated that the vendor was Robb’s Electric. When
I asked for the name of the specific individual who made the alleged complaint to him, Mr. Gruenhagen avoided providing the requested information.

The ‘accused’ has the ‘right’ to know his accuser. If, in fact, one even exists.

A single refusal, by Mr. Gruenhagen, to provide the requested information to an elected City Council member is grounds for disciplinary action. Yet, Mr. Gruenhagen
compounded his improper conduct by refusing to provide the requested information to me a second, and a third, time, is unconscionable.

I sent Mr. Gruenhagen three e-mails formally asking him to identify the person from Robb’s Electric who made the alleged complaint. These written requests were sent on September 10, 2014,  September 11, 2014 and September 13, 2014.

When requested and as a city employee, Mr. Gruenhagen is obligated to provide information to any member of the Hamburg City Council. Yet, he has NEVER
provided the name of the person(s) representing Robb’s Electric that he (allegedly) has spoken with.

III
INAPPROPRIATE INVOLVEMENT

I can ‘speak for myself’; and choose to do so.

On Saturday, September 13, 2014, I met with Mayor Malz, at his home, to discuss what had taken place at the September 9th Hamburg City Council meeting. I expressed my dismay at the manner in which Mr. Gruenhagen, without my knowledge or authorization, (apparently) freely and openly discussed my involvement and interaction with someone representing Robb’s Electric and opted to ’speak on my behalf’.

Mayor Malz agreed with me that Mr. Gruenhagen’s talking with anyone from Robb’s Electric about my demeanor with employees of their company, instead of talking directly with me, was improper. I suggested to Mayor Malz that Mr. Gruenhagen “…..wouldn’t do it to you”; to which the Mayor replied words to the effect, “I can speak for myself.”

So can I.

Mr. Gruenhagen’s entire, unsolicited conduct in this matter, on my behalf and without my authorization, coupled with his steadfast refusal to provide the
information requested by me, an elected official of the City of Hamburg, is unacceptable. 
IV
INAPPROPRIATE CONDUCT

There is no place for rudeness and abusive language in the workplace. Blatant rudeness and the use of foul language is usually considered gross misconduct, especially if it is regularly demonstrated on the job.

On numerous occasions and since approximately September 2013, I personally have observed Mr. Gruenhagen in highly agitated states while on duty at the Hamburg City Office. During his vociferous tirades and uncontrolled outbursts, Mr. Gruenhagen has stated how much he dislikes his job, how he can’t (paraphrasing) ’get my work done’, how much he is (paraphrasing) ’bothered’ by ‘everyone coming into my office’ preventing him from doing his work, how he just wants a job where (paraphrasing) “I can sit in my own little cubicle and do my work without being bothered.’

Eventually, because of the quantity and severity of his tirades and outbursts and his claiming, numerous times, (paraphrasing) “...this job is affecting my family” , I offered a possible, positive alternative by stating (words to the effect) “….If this job is affecting you and your family so badly, perhaps it would be better for you and your family for you to seek an alternate, more suitable source of employment.”

Additionally, Mr. Gruenhagen has threatened to “...quit my job” numerous times because it (apparently) is too overwhelming for him at times. In fact, he had an unsigned Letter of Resignation that he had written sitting in plain view, on his desk, that was observed by another City Council member and possibly other city employees.

While I used to frequently visit City Hall two or three times a week, I have intentionally avoided stopping in at City Hall since approximately June of this year because of what I consider Mr. Gruenhagen’s unacceptable behavior and all of the ‘negativity’ within the confines of City Hall.

V
PROFANITY

Profanity is language or behavior that is considered to be vulgar, rude or offensive. The use of profanity in everyday life, such as in the workplace, can be deemed appalling or even disrespectful to those around us.

Because of the open use of profanity that I had basically continuously observed previously, I sent an e-mail message, on April 14, 2013, to Mr. Gruenhagen that, among other things, requested that all city officials ‘be more cognizant’ of their inappropriate use of profanity while representing the City of Hamburg.

During his tirades and uncontrolled outbursts, Mr. Gruenhagen has frequently been heard to freely use profanity (such as slang for fecal material and using the Lord’s name in vain)
when other employees and/or City Council members are present.

Particularly troubling to me is the frequent use of the “F-Bomb’ profanity in the presence of our newly hired female Deputy City Clerk. When I met with Mayor Malz on September 13th, I also discussed the issue of profanity in the presence of the city’s newly hired Deputy City Clerk.

Deputy Malz agreed that such language is not acceptable and that he would talk with the Deputy City Clerk. A week or two ago I asked the Deputy City Clerk if, in fact, the Mayor had spoken to her about the overall ‘working environment’ at City Hall.

She stated that he had not.

And when I brought a vendor to the City Hall with the intention of introducing him to the Hamburg’s City Clerk/Treasurer, when we walked into the building, the first thing we heard
was Mr. Gruenhagen screaming “THEY CAN TAKE THIS JOB AND SHOVE IT” to whoever he was talking to on the (city’s) telephone.

The embarrassment I experienced is indescribable; I apologized to the vendor by saying (words to the effect), “Jeremy must be having another ‘bad day’” and we immediately left the building.

The only two OTHER City Officials that I quickly realized had ANY 'decency and common sense', were the then MAYOR DICK MALZ
(no Webpage) and then CITY COUNCILMEMBER STEVE TREBESCH (also no Webpage). As for the 'contract' City Attorney,
KELLEY C. DOHM well, she joins HAMBURG CITY CLERK/TREASURER JEREMY GRUENHAGEN and HAMBURG
MAYOR CHRIS LUND who ALL DESERVE  to have THEIR OWN, INDIVIDUAL WEBPAGES because of their
involvement in what's taken place that you been reading about taking place in the CITY OF HAMBURG,
on my Websites about the CITY OF HAMBURG; for the past 5 YEARS !!

A public officer or employee who does any of the following, for which no other sentence is specifically provided by law, may be sentenced to imprisonment for not more than one year or to payment
of a fine of not more than $3,000, or both

(1) intentionally fails or refuses to perform a known mandatory, nondiscretionary, ministerial duty of the
office or employment within the time or in the manner required by law; or

(2) in the capacity of such officer or employee, does an act knowing it is in excess of lawful authority or
knowing it is forbidden by law to be done in that capacity; or

(3) under pretense or color of official authority intentionally and unlawfully injures another in the other's
person, property, or rights; or

(4) in the capacity of such officer or employee, makes a return, certificate, official report, or other like
document having knowledge it is false in any material respect.

When I joined the Hamburg City Council On January 1, 2013, it sure didn't take me long to realize that HAMBURG'S CITY CLERK/TREASURER
JEREMY GRUENHAGEN had 'issues'. As the weeks and months passed, I realized that I was suddenly elected to a real 'deleterious quagmire'
that I would continuously learn about, experience and be wittness to. While I initially didn't give much thought to the 'root cause' of what I
was observing, when I started doing some 'serious thinking' about what was taking place that I was witnessing, it soon became
evident to me that the 'common denominator' seemed to always be HAMBURG'S CITY CLERK/TREASURER.

And THAT's what turned out to 'be the case' for the NEXT FOUR YEARS !!

As I predicted last spring what was going to happen, now that the CITY OF HAMBURG, at GREAT EXPENSE; has successfully 'bilked' privately owned property
out of the Hamburg resident that previously owned it, the City has now 'fired the first salvo' in trying to FORCE THE RESIDENT OUT OF BUSINESS !!
(The CITY OF HAMBURG WASTED BETWEEN $80,000.00 - $100,000.00 HAMBURG TAXPAYER DOLLARS
in their disgusting and underhanded efforts, and REFUSES to provide the EXACT DOLLAR AMOUNT !!)

THE CITY'S VINDICTIVE ACTION AGAINST A TAXPAYING RESIDENT, also COST THAT HAMBURG RESIDENT (about) $40,000.00 !! As is
SO OFTEN THE CASE, the only 'winners' in this long, protracted abuse of authority by the CITY OF HAMBURG, were THE LAWYERS !!

Listening to the audio recording of the September 24th HAMBURG CITY COUNCIL MEETING, clearly reveals
the beginning of the City's DESPICABLE, 'thinly veiled' attempt to 'run the guy out of town' !!

The City seems to forget about the 'GRANDFATHER CLAUSE' of 'LAND OWNERSHIP' !! (A grandfather clause is a legal provision that allows some
existing situations to be governed by an old rule while a new rule applies to future cases. It's also known as a legacy clause.)

To no one's surprise, the two HAMBURG CITY OFFICIALS 'spearheading' this devious and sinister 'plot' and ABUSE OF AUTHORITY, are
HAMBURG MAYOR CHRIS LUND and HAMBURG CITY CLERK TREASURER JEREMY GRUENHAGEN !!

Of course, the NAMES of these TWO HAMBURG CITY OFFICIALS are VERY FAMILIAR to visitors to my Websites and are
'referenced' frequently on those Websites exposing their CORRUPT and ILLEGAL ACTIONS !!

For those of you who may not know who these two 'schlocks' really are and their serous deficit of ANY MORAL CHARACTER WHATSOEVER and
as JUST ONE EXAMPLE, LUND'S SON committed vandalism against CITY PROPERTY, OWNED BY HAMBURG TAXPAYERS !!

HOWEVER; the ACTIONS of 'LUND'S KID' were 'COVERED-UP' by the CITY OF HAMBURG and 'LUNDS KID' WAS NEVER HELD
ACCOUNTABLE FOR HIS CRIMINAL ACTS AGAINST THE DIGNITY of ALL of the other HAMBURG RESIDENTS !!

609.43 MISCONDUCT OF PUBLIC OFFICER OR EMPLOYEE
A public officer or employee who does any of the following, for which no other sentence is specifically provided by law, may be sentenced to imprisonment for not more than one year or to payment of a fine of not
more than $3,000, or both

(1) intentionally fails or refuses to perform a known mandatory, non-discretionary, ministerial duty of the office
or employment within the time or in the manner required by law; or

(2) in the capacity of such officer or employee, does an act knowing it is in excess of lawful authority or
knowing it is forbidden by law to be done in that capacity; or

(3) under pretense or color of official authority intentionally and unlawfully injures another in the other's
person, property, or rights; or

(4) in the capacity of such officer or employee, makes a return, certificate, official report, or other like
document having knowledge it is false in any material respect.

Because HAMBURG PUBLIC OFFICIALS Have NO ACCOUNTABILITY, BREAKING THE LAW Is MORE 'CONVENIENT' (And BENEFICIAL
To Them) Than FOLLOWING THE LAW !! That Was One Of The FIRST THINGS I NOTICED TAKING PLACE When I Was Elected
To The HAMBURG CITY COUNCIL (2013-2017 ) And, Apparently; HAS BEEN TAKING PLACE For MANY, MANY YEARS !!

351.14 DEFINITIONS.
Subdivision 1.Applicability. The definitions in this section apply to sections 351.14 to 351.23.

Subd. 2.Malfeasance. "Malfeasance" means the willful commission of an unlawful or wrongful act in the performance of a public official's duties which is outside the scope of the authority of the public official and which infringes on the rights of any person or entity.

Subd. 3.Nonfeasance. "Nonfeasance" means the willful failure to perform a specific act which is a required part of the duties of the public official.

Subd. 4.Misfeasance. "Misfeasance" means the negligent performance of the duties of a public official or the negligent failure to perform a specific act which is a required part of the duties of the public official.

Subd. 5.Elected county official. "Elected county official" means any public official who is elected to countywide office or appointed to an elective countywide office, including county attorney, (SEE BELOW) county sheriff, county auditor, county recorder, county treasurer, and soil and water conservation supervisor. "Elected county official" also means a county commissioner elected or appointed from a commissioner district or a soil and water conservation district supervisor elected or appointed from a supervisor district established under section 103C.311, subdivision 2.

I was ABSOLUTELY CERTAIN that HAMBURG CITY CLERK/TREASURER JEREMY GRUENHAGEN had lied to me; no question in my mind, at all. Additionally, because of my previous 'experiences' with ATTORNEY KELLY DOHM of the Waconia based law firm of MELCHERT, HUBERT & SJODIN during my City Council term and now, because of her 'involvement' in this current, 'pending litigation' against the City of Hamburg, I had to verify the 'facts' that were already so obvious to me (and should be to YOU) about what had taken place. I already had the 'evidence' I needed to PROVE that the City of Hamburg had overtly, and intentionally, lied to me, but I wanted more 'facts and information' to solidify my allegations 'beyond a reasonable doubt'; the 'legal standard' required to convict an person accused of committing a crime(s).

WHY ARE HAMBURG CITY OFFICIALS 'ABOVE THE LAW' ??
"COMMON SENSE 101" UPDATE

On December 20, 2019 after witnessing, for THREE MONTHS, what was taking place in the City of Hamburg by it's ELECTED and OTHER CITY OFFICIALS, I contacted the Carver County Attorney, Mark Metz, and advised him of what I was observing taking place. CARVER COUNTY ATTORNEY METZ NEVER RESPONDED to my WRITTEN CONCERNS that I called to his attention !!

The last time I checked, when a 'citizen', in 'good faith', reports what he believes to be a crime taking place, or believed to have taken place, that report should be TAKEN SERIOUSLY and THOROUGHLY INVESTIGATED; NOT MINIMIZED and DISMISSED because of the IDENTITY OF THE INDIVIDUALS INVOLVED !! Strike ONE.

On MARCH 3, 2020, and MORE THAN TEN WEEKS WITH NO RESPONSE OR ACKNOWLEDGEMENT from him, I sent a very detailed and descriptive letter to Carver County Attorney Metz further advising him in greater detail of what I had 'discovered'; this time I also enclosed  corroborating documentation, evidence and information; further describing what  was taking place in the City of Hamburg by it's ELECTED and OTHER CITY OFFICIALS.

(NOTE: Because I believe in honesty, integrity and 'transparencyof government in general and of 'Public Officials' specifically, pretty much ALL of the information I submitted to Carver County Attorney Metz is available on this Website, and related Webpages, for the public to view.)

As he had done (or not done) previously, Carver County Attorney Metz, once again, NEVER RESPONDED to my WRITTEN CONCERNS !! Strike TWO.

Then, after NOT RECEIVING ANY ACKNOWLEDGEMENT to EITHER of my TWO previous communications him, I AGAIN, on JUNE 10, 2020, sent a THIRD communication to Carver County Attorney Metz basically asking him what his 'intentions' were as to the information that I had preciously called to his attention. Strike THREE.

FINALLY, on SATURDAY, JUNE 27, 2020, I received a reply** from Deputy Carver County Attorney Peter Ivy (who I had previously become aware of during my four year Hamburg City Council term; 2013-2016) regarding my reporting, OVER SIX MONTHS EARLIER, of what was taking place in the City of Hamburg by it's ELECTED and OTHER CITY OFFICIALS. (The MINNESOTA LAWYERS PROFESSIONAL RESPONSIBILITY BOARD takes a VERY DIM VIEW  of attorneys who don't keep in contact with their clients, attorney's who 'ignore' the requests of, or inappropriately respond to, a client. I'm sure colleges and universities teach attorneys that in 'Attorney School 101'.) In this particular case, I, as a taxpaying resident of Carver County, observed and reported, in 'good faith', apparent illegal activity by a Public Official(s). As a former, long-time 'public servant' myself, in the Law Enforcement Profession, I had a compelling sense of duty, responsibility and the moral obligation to report my observations to the Carver County Attorney whom I had entrusted to properly respond to, and deal with, my observations, concerns. well intentioned good will and subsequent report, involving what I believed to be PUBLIC OFFICER MISCONDUCT by HAMBURG CITY OFFICIALS; a violation of Minnesota Stature 609.43 of the MINNESOTA CRIMINAL CODE

In the letter I received June 27, 2020  from Mr. Ivy, he CLEARLY stated: "It is possible that the City Clerk was simply mistaken with his information......" (It is also possible that a man who walked into a bank brandishing a machine gun or AK-47 also 'was simply mistaken'.) Minnesota Statute 628.61 Subdivision 3 CLEARLY STATES "The grand jury shall inquire into the willful and corrupt misconduct in office of all public officers in the county."

How can ANYBODY DISPUTE THAT STATUTE OR IT'S INTENT ? Read the information I've provided on the pages of this Website, and related Webpages; then make your own decision as to whether or not you think there's 'cover-up' taking place. Or, perhaps; ANOTHER WORD that begins with the letter 'C' !! I can think of a number of other words beginning with the letter 'C' to describe what's taking place; how about YOU ??

Yet; the letter from Mr. Ivy goes on to state, "A grand jury will not be convened in this matter because your letter, in itself, does not constitute probable cause* to believe a crime was committed." (Pass out the 'white canes' to Mr. Ivy and the other employees working in the Carver County Attorney's Office, and put up signs throughout Carver County stating, "IT'S O.K. FOR PUBLIC OFFICIALS TO LIE, BE DISHONEST & LACK INTEGRITY"; Violators Will NOT Be Prosecuted !!)

For the Carver County Attorney's Office to state that 'probable cause' doesn't exist in this matter; that is just plain BULLSHIT !! (Now; I HOPE I just got somebody's attention !!) Let me give you a couple of 'text book definitions' of 'Probable Cause':

'Probable Cause' is defined as "A reasonable grounds of suspicion supported by circumstances sufficiently strong in themselves to warrant a conscientious man into believing that a crime has been committed and the accused committed that crime. And then there's this:

'Probable Cause' requires more than a mere suspicion that a suspect committed a crime, but not an absolute certainty. 'Probable cause'* is the legal standard that requires facts or evidence in a given situation that would lead a reasonable person to believe that a suspect has committed a crime and that suspect accused, did, in fact, commit the crime of which he or she is accused. (*In Illinois v. Gates, 462 U.S. 213, 232 (1983), the Court favored a flexible approach, viewing 'Probable Cause' as a "practical, non-technical" standard that calls upon the factual and practical considerations of everyday life on which reasonable and prudent men [...] act". (Courts often adopt a broader, more flexible view of 'Probable Cause' when the alleged offenses are serious.) Like involving 'Public Officers and Employees', maybe?

EVERY  'rookie' Law Enforcement Officer, ME INCLUDED, learns the elements of 'Probable Cause' as part of their Law Enforcement Training. I PERSONALLY  learned what 'Probable Cause' consists of when I attended my BASIC POLICE SCIENCE COURSE  training presented by the MINNESOTA BUREAU OF CRIMINAL APPREHENSION at the MINNESOTA STATE PATROL TRAINING FACILITY in Arden Hills !! I also learned about 'Miranda Warnings'.

But I really don't need 'Probable Cause' in dealing with what I observed take place by HAMBURG CITY OFFICIALS; I HAVE THE ACTUAL, PHYSICAL EVIDENCE in this particular case, the ACTUAL DOCUMENT that I received from, and authored by, the Hamburg City Clerk/Treasurer (a copy of which is available on this Website) showing ABSOLUTE IRREFFUTABLE EVIDENCE of a CLEAR and INTENTIONAL VIOLATION of Minnesota Statute 609.43 Subdivision 4 of the MINNESOTA CRIMINAL CODE, INTENTIONALLY CONTAINED FALSE INFORMATION that was INTENTIONALLY SENT TO ME BY THE ACCUSED !!

By FAILING TO ACT APPROPRIATELY, the STAFF of the Carver County Attorney's Office is DIRELECT in it's DUTY and RESPONSIBILITY TO THE CITIZENS OF CARVER COUNTY by FAILING to be IMPARTIAL, UNBIASED and instead, being PREJUDICIAL IN FAVOR OF HAMBURG PUBLIC OFFICIALS because of WHO ELSE WILL BE IDENTIFIED and will also be IMPLICATED !!

In addition to NOT REMAINING IMPARTIAL and NOT DOING THEIR JOB because of WHO IS INVOLVED and who will ALSO be 'implicated', the Carver County Attorney's Office is AIDING and ABETTING in the PREVENTION of CITY OF HAMBURG PUBLIC OFFICIALS BEING HELD ACCOUNTABLE FOR THEIR CRIMINAL  ACTIONS, BECAUSE OF WHO THEY ARE !!

I've been to this 'Hamburg Rodeo' before when I was a Member of the Hamburg City Council (2013-2016) and observed then what was taking place in our very small City, by Hamburg City Officials. (The CITY WASTED $50,000.00 TAXPAYER DOLLARS in their (unsuccessful) effort to force me off the City Council so I wouldn't know, and then be unable to reveal, what I was observing take place !!) There is probably nothing more despicable than 'Public Officials' that lack integrity, yet; have unlimited access to Taxpayer Dollars !! And It's HAPPENING RIGHT HERE IN THE CITY OF HAMBURG !!

And equally disgusting: Persons in 'political positions', and lawyers, simply do not 'take on' or challenge other persons in 'political positions', or other lawyers. It's like a 'Code of Silence' exists.

LOOK: When a pharmacist is given a prescription that contains false information intended to obtain prescription drugs illegally, it's called "UTTERING A FORGED PRESCRIPTION (or DOCUMENT"). When a bank teller is given a check by someone who is not authorized to issue the check with the intent to deceive the bank and/or the bank teller, it's called "UTTERING A FORGED INSTRUMENT (or DOCUMENT").

Either way, SOCIETY (and the law) dictate that they get arrested, they go to jail, and then they go to court to be held accountable for their actions. Same principle, in this case. At least it SHOULD be !! But it DOESN'T because of WHO IS INVOLVED !!

The decision, by Carver County Attorney Metz's Office, to NOT PURSUE THIS COMPLAINT OF MISCONDUCT OF PUBLIC OFFICERS AND EMPLOYEES any further,  REQUIRES MUCH CLOSER SCRUTINY by an IMPARTIAL AGENCY. While the identity of the accused, and his alleged criminal act(s) are publicly known, the desire and REFUSAL of the Carver County Attorney's Office to take SWIFT, PROPER and APPROPRIATE  ACTION, as REQUIRED BY LAW simply because the Carver County Attorney's Office is covertly attempting to KEEP THE IDENTITY OF SUSPECTS & POTENTIAL 'ACCOMPLICES' CONCEALED because of their involvement and status within Carver County and the related 'legal community' itself,  REEKS of IMPROPRIETY !!

With that type of attitude, thinking and 'behavior', it's EASY TO SEE  why CARVER COUNTY TAXPAYERS JUST PAID OUT $450,000.00 BECAUSE CARVER COUNTY OFFICIALS, (Including Carver County Attorney Mark Metz) RELEASED PRIVATE INFORMATION regarding a case in which his Office was involved, AND MADE THAT PRIVATE INFORMATION PUBLICLY AVAILABLE !!

Also, please see Minnesota Statute 609.43 of the Minnesota Criminal Code; "MISCONDUCT OF PUBLIC OFFICER OR EMPLOYEE". Additionally, by refusing to take any action, isn't Carver County Attorney Mark Metz himself, likewise guilty of violating Subdivision 1 of that same Minnesota Statute ?? It is the Carver County Attorney's job to PROSECUTE, NOT PROTECT, those who BREAK THE LAW, REGARDLESS OF WHO THEY ARE; not to SHIELD THEM FROM PROSECUTION because of WHO THEY ARE !! 'SELECTIVE CRIMINAL PROSECUTION' in Carver County involving 'PUBLIC OFFICIALS' ? And, has anyone ever heard of Minnesota Statute entitled 'OBSTRUCTION OF JUSTICE' ?? "Cue CBS NEWS SIXTY MINUTES, DATELINE NBC, ABC's 20/20 and all the rest.

I have always been, and will ALWAYS continue to be, a loyal and staunch supporter of 'First Responders'; the Police Officers, the Firefighters, the Emergency Medical Services Personnel, the 9-1-1 Dispatchers and our Military; my Websites, and my Weekly Internet Shows, convey that fact adequately, emphatically and unquestionably. I realize that everybody is all concerned about holding local Police Officers accountable; I 'get that'. But don't judge the entire Law Enforcement Profession and the deplorable and 'stupid' acts and decisions of a few of the 'rogue ones', that EVERY profession has. Also, how about holding ALL other City, County and State 'Public Officials' accountable for their actions or lack thereof ?? That CERTAINLY would solve the problem we're now facing here, in the CITY OF HAMBURG AND in CARVER COUNTY !! Think about that; even if for just a minute.

ALL County Attorneys have the ETHICAL, MORAL & LEGAL RESPONSIBILITY  to criminally, and IMPARTIALLY PROSECUTE ANYONE who breaks the law; REGARDLESS Of WHO THEY ARE, THEIR PROFESSION or THEIR STANDING IN THE COMMUNITY !! A criminal is a criminal is a criminal and MUST be dealt with swiftly, appropriately and according to law. 'Cozy relationships' with local elected 'Public Officials', like the one that exists between the City of Hamburg and the Carver County Attorney's Office, are detrimental to, and demolish, the ethical, moral and legal responsibilities of the proper, impartial administration of the Criminal Justice System that citizens deserve and demand, of those person(s) accused. 

The Carver County Attorney's Office has FAILED MISERABLY in their (statutory) duty and responsibility to Carver County residents to act impartially and responsibly, because of the identity and 'position'(s) of current, and FORMER CITY OF HAMBURG PUBLIC OFFICIAL(s) INVOLVED and the possibility of WHO ELSE WILL ALSO BE IMPLICATED in what is taking place in the CITY OF HAMBURG by it's PUBLIC OFFICIALS !!

Don't 'dance around' what's taking place; call it what it is: A ''COVER-UP" !!

In OUR America, citizens EXPECT that PERSONS WHO VIOLATE THE LAW, especially 'PUBLIC OFFICIALS', will be HELD ACCOUNTABLE FOR THEIR ACTIONS REGARDLESS of WHO THEY ARE, the 'position' that they hold' or how important they think they may be. It's as simple as that !! The fine residents of  Carver County EXPECT and DESERVE, 'transparency' and impartiality from, and within, the Carver County Attorney's Office. That HASN'T BEEN ALLOWED TO HAPPENED in this case; because of who is involved as well as who else will also be implicated, once a VIGOROUS and THOROUGH INVESTIGATION is conducted by an 'OUTSIDE, INDEPENDENT AGENCY !!

Then, and ONLY then, will true and proper Justice, be served. Yes; it's as simple as that !!

Through a 'contract arrangement' with the City, the Waconia based MELCHERT, MELCHERT & SJODIN law firm supplies one (or more) of their attorney's to provide the City of Hamburg its legal service and (poor) legal advice. Kelly Dohm, with whom I am thoroughly all too familiar, is a 'partner' of that firm.

This seemingly innocuous reply, shown above, by the Hamburg City Clerk/Treasurer to my request, also shown above, IRREFUTABILITY PROVES BEYOND ANY DOUBT WHAT-SO-EVER the intentional and knowledgeable involvement of the Waconia based law firm of MELCHERT, HUBERT & SJODIN, and AT LEAST ONE of their attorneys, with what is currently, and has been, taking place in the City of Hamburg for WELL OVER A YEAR !!

When the City of Hamburg, upon the advice, direction and guidance of Attorney Kelley Dohm, was trying to (unsuccessfully) 'silence' me & my Website during my City Council term (2013-2016)
by trying to (unsuccessfully) force me to resign my position with the Hamburg City Council,
Dohm's law firm, MELCHERT, HUBERT & SJODIN, was paid about
$50,000.00 TAXPAYER DOLLARS !!

351.14 DEFINITIONS.
Subdivision 1.Applicability. The definitions in this section apply to sections 351.14 to 351.23.

Subd. 2.Malfeasance. "Malfeasance" means the willful commission of an unlawful or wrongful act in the performance of a public official's duties which is outside the scope of the authority of the public official and which infringes on the rights of any person or entity.

Subd. 3.Nonfeasance. "Nonfeasance" means the willful failure to perform a specific act which is a required part of the duties of the public official.

Subd. 4.Misfeasance. "Misfeasance" means the negligent performance of the duties of a public official or the negligent failure to perform a specific act which is a required part of the duties of the public official.

Subd. 5.Elected county official. "Elected county official" means any public official who is elected to countywide office or appointed to an elective countywide office, including county attorney, (SEE ABOVE) county sheriff, county auditor, county recorder, county treasurer, and soil and water conservation supervisor. "Elected county official" also means a county commissioner elected or appointed from a commissioner district or a soil and water conservation district supervisor elected or appointed from a supervisor district established under section 103C.311, subdivision 2.

(1) intentionally fails or refuses to perform a known mandatory, nondiscretionary, ministerial duty of the office or employment within the time or in the manner required by law; or

(2) in the capacity of such officer or employee, does an act knowing it is in excess
of lawful authority or knowing it is forbidden by law to be done in that capacity; or

(3) under pretense or color of official authority intentionally and unlawfully injures another in the other's person, property, or rights; or

(4) in the capacity of such officer or employee, makes a return, certificate, official report, or other like document having knowledge it is false in any material respect.
