2022 MINNESOTA STATUTES

609.43 MISCONDUCT OF PUBLIC OFFICER OR EMPLOYEE.

A public officer or employee who does any of the following, for which no other sentence is specifically provided by law, may be sentenced to imprisonment for not more than one year or to payment of a fine of not more than $3,000, or both:

(1) intentionally fails or refuses to perform a known mandatory, nondiscretionary, ministerial duty of the office or employment within the time or in the manner required by law; or

(2) in the capacity of such officer or employee, does an act knowing it is in excess of lawful authority or knowing it is forbidden by law to be done in that capacity; or

(3) under pretense or color of official authority intentionally and unlawfully injures another in the other's person, property, or rights; or

(4) in the capacity of such officer or employee, makes a return, certificate, official report, or other like document having knowledge it is false in any material respect.

During my Hamburg Mayoral Campaign last fall, I posted information on my Website about the telephone company CENTURYLINK agreeing to pay the State of Minnesota $8.9 MILLION DOLLARS to about 12,000 current and former Minnesota customers who were 'victimized' for CENTURYLINK's alleged 'fraudulent billing practices'.

I'm curious to know if anyone who was eligible for the $480.00 refund from CENTURYLINK (and filed the required 'Refund Claim Form BEFORE LAST OCTOBER'S DEADLINE) ever received their CENTURYLINK refund.

It's now been OVER FOUR MONTHS since I spoke with the Minnesota Attorney General's Office (on May 3, 2023 @ 11:26AM) and I haven't received my refund check for $480.00 or heard anything further about why it's taking so long. (During my telephone conversation with them, I was told by the Minnesota Attorney General's Office that the refund checks were supposed to 'start going out' within about two weeks from my May 3rd telephone conversation.)

It's 'troubling' to have learned that even though there was $8.9 MILLION DOLLARS paid by CENTURYLINK to the State of Minnesota to settle the suit brought against them, ONLY 3,000 PEOPLE APPLIED (of the 12,000 people eligible) for the refund.

While it's NOT KNOWN how many people (if anybody) ACTUALLY RECEIVED the $480.00 refund; that's the purpose for me posting this request for additional information. If, per chance, you got your $480.00 refund, I'd like to hear from you at [email protected], so I can figured out how much of the $8.9 MILLION DOLLARS was actually 'refunded' to current and former Minnesota CENTURYLINK customers. EVEN IF all 3,000 applicants that applied DID, in fact; receive their payments (and we KNOW that didn't happen), that amounts to only $1.4 MILLION DOLLARS, and

LEAVES $7.5 MILLION DOLLARS

UNACCOUNTED FOR !!

In response to my inquiry to the Minnesota Legislative Auditor's Office of WHATEVER HAPPENED TO THAT $8.9 MILLION DOLLARS THAT THE STATE OF MINNESOTA RECEIVED FROM CENTURYLINK, here's the relevant portion of an e-mail that I received from that Agency, today:

Thank you again for contacting the Office of the Legislative Auditor (OLA) with your concerns regarding the Attorney General’s Office’s (AGO) handling of a class-action settlement with CenturyLink. We appreciate your patience as we worked to further investigate your concern. AGO generally does not make settlement payments until all claimants have been verified. Depending on the number of claimants in any particular case, this process can be quite lengthy. We regret that would could not be of greater assistance, but hope the above information is helpful.

SUBJECT: Vandalism - Bi-Centennial Park

1. I am still awaiting your 'Yes or No' answer to my numerous inquiries as to whether or not you told a City resident that the vandalism to the tree(s) in Bi-Centennial Park, believed to have been caused by means of a 'claw' hammer on or about July 31, 2018; was caused by the son of Hamburg Mayor Christopher M. Lund.

2. It is my understanding that additional vandalism occurred to various buildings at Bi-Centennial Park on or about July 31, 2018, and that said acts of vandalism were believed to have been caused by means of a 'claw' hammer.

Who was/were the perpetrator(s) of said vandalism to those various City buildings and what criminal action was taken/authorized by the City against the perpetrator(s) for their act of vandalism of City property ?

3. Regarding the FELONY LEVEL of vandalism, amounting to approximately $1,400.00; of the City sign at Bi-Centennial Park on or about May 26, 2020, who was/were the perpetrator(s) of said vandalism and what criminal action was taken/authorized by the City against the perpetrator(s) for their act of vandalism of City property ?

4. It also is my understanding that damage to a locking door handle at the Hamburg Community Hall/City Shops occurred on or about October 2, 2017 and that the City sustained the loss (theft) of certain items as a result. If 'forced entry' occurred, as one would believe to have taken place; I, personally; would classify that action as a burglary.

Who was/were the perpetrator(s) of said burglary, what items were stolen, what is the total value of all items stolen, what is/was the cost of repair/replacement of the locking door handle that was damaged and what criminal action was taken/authorized by the City against the perpetrator(s) for their acts of vandalism, apparent burglary and theft of items from the City owned building ?

5. The Carver County Sheriff's Office has NO REPORT of any acts of vandalism having taken place at the Service Memorial in Bi-Centennial Park.

It is common knowledge that juveniles have been seen climbing on, and vandalizing the statues. In fact, the rifles of one of the statues had the barrel of a gun held by one of the statues, literally 'broken off'.

Why wasn't a formal report of vandalism made to the Carver County Sheriff's Office for this act of vandalism of City property, who was/were the perpetrator(s) of said vandalism and what criminal action was taken/authorized by the City against the perpetrator(s) for their act of vandalism ?

In any of the incidents described above, was any form of restitution received by the City and if so, how much restitution was received by the City, and from whom was the restitution received ?

With the exception of item (1) above, did ANY of the other incidents described above; involve the children of ANY of the ELECTED PUBLIC OFFICIALS of the CITY OF HAMBURG ?

The appropriate completed 'Request For Information' forms, as required by the City of Hamburg; are attached with this e-mail request for PUBLIC information.

I await your response and caution you to receive, consider and respond to these inquiries with the same degree of seriousness with which the inquiries are sent.

ANY ATTEMPT to 'STONEWALL' the providing of the information requested herein, as has taken place so many times in the past and as recently as January 26, 2024 and January 29, 2024, would NOT be in the best interests of the City of Hamburg or its PUBLIC OFFICIALS, is NOT ACCEPTABLE and will be dealt with SWIFTLY, HARSHLY and DIRECTLY.
